The new Telecom Act-2023 is about to come into effect. The new law repeals existing legislative frameworks like Indian Telegraph Act,1885 and Indian Wireless Telegraph Act, 1933.

The new telecom law has strict provisions against purchase of SIM cards and fake connections, call tapping. In December last year, the central government introduced the new Telecom Bill in the Lok Sabha. After the bill was introduced, it also received the President’s assent. Now some provisions of this law are going to be implemented from June 26. This new telecom law may bring problems for people who buy more than 9 SIM cards.

If more than 9 SIM cards are issued from a user’s Aadhaar card, a fine of Rs 50,000 can be levied for the first mistake and up to Rs 2 lakh for repeated mistakes. Apart from this, if the user ID is used fraudulently to purchase a SIM card, the punishment is imprisonment up to 3 years and fine up to Rs.50 lakhs or both imprisonment and fine. This includes sim card spoofing i.e. hiding your identity from the receiver. Apart from this, telecom operators will have to verify users only through biometric based identification ie Aadhaar card.

The Telecommunications Act 2023 introduces a provision for up to Rs 2 lakh penalty for operators sending commercial messages sent without the user’s consent.

The law allows government to grant permission to telecom companies to install mobile towers or lay telecom cables on private properties, if necessary.
